Restrictions

4 of these 5 governing documents provide instructions for amendment and/or termination.  The 5th document, Enforcement of Deed Restrictions, does not provide guidance for amendments.  

Amending the Articles of Incorporation 

The corporation reserves the right to amend, alter, change or repeal any provision contained in these Articles of Incorporation in the manner now or hereafter prescribed by law, and all rights and powers conferred herein on members, directors and officers are subject to this reserved power.

Amending the Declaration
The Association may be given additional powers as may be delivered by the members, and this instrument may be otherwise amended by the written consent of the owners constituting two-thirds (⅔) of the total number of eligible votes as defined in Article II, evidenced by an agreement duly executed, acknowledged, and recorded in the office of the Register of Deeds in Johnson County, Kansas.

Terminating the Declaration
This Declaration may be terminated, and all of the land now or hereafter affected may be released from all the terms and provisions of this Declaration by an affirmative vote of owners constituting two-thirds (⅔) of the total number of eligible votes as defined in Article II execute and acknowledge an appropriate agreement or agreements for that purpose and file the same in the office of the Register of Deeds of Johnson County, Kansas.

Amending Declaration of Restrictions
The restrictions herein set forth shall continue to be binding upon the Developer and upon its successors and assigns until December 31, 1998, and shall automatically be continued thereafter for successive periods of five (5) years each, provided, however, that the owners of the fee simple title to more than sixty percent (60%) of the lots bound by these restrictions may release all or any part of the restrictions herein set forth, on December 31, 1978, or at the end of any successive five-year period thereafter, by executing and acknowledging an appropriate agreement or agreements in writing for each purpose and filing same for record in the office of the Register of Deeds of Johnson County, Kansas, prior to December 31, 1997 or at least one (1) year prior to the expiration of any successive five (5) year period after December 31, 1998.

Amending the Bylaws These bylaws may be amended, altered, repealed, or added to at any regular meeting of members or at any special meeting called for that purpose, by affirmative vote of a majority of the members entitled to vote.
